TandemHealth™ Privacy Policy

This TandemHealth™ Privacy Policy (“Privacy Policy”) governs your use of the TandemHealth™ mobile software application (“Application”) created by Consumers Union of United States, Inc., the non-profit organization doing business as Consumer Reports (“Consumer Reports,” “we” or “us”). This Application offers information about health conditions and associated treatment options and is intended for use by health professionals and adult consumers.

By downloading and using this Application, you consent to the terms of this Privacy Policy, which is a part of the Consumer Reports End User License Agreement.

1. SCOPE

This Privacy Policy describes the types of information we collect when you use this Application and how that information is used. This Privacy Policy does not apply to any other Consumer Reports products or services. It does not apply to information that may be collected from you or your mobile device by your wireless carrier, the mobile device manufacturer or platform, so we recommend that you read those privacy policies.

2. INFORMATION WE COLLECT AND HOW WE USE IT

User Provided Information

This Application does not ask you to provide any personally identifiable information such as your name, phone number, email address or street address. If you use your mobile device to email or text the Application’s content to another person, this Application does not collect sender or recipient email addresses or mobile phone numbers.

Automatically Collected Information

We and our service providers use technology to automatically access, collect, monitor and store certain information from and about the device you use to download and access this Application so that we can better understand, improve, host and protect this Application. This information includes:

  • Internet Protocol (IP) address, which has the potential to identify you personally.
  • Device identifier, which is a small data file stored on or associated with your device, which uniquely identifies it to us. This device identifier tells us how you search and use the Application and how content is shared with others.
  • Anonymous information, such as:
    • Geographic location at city/state level, as derived from your device’s IP address. This Application does not collect your precise geographic (i.e., street address) location.
    • Wireless carrier
    • Device manufacturer
    • Device model
    • Operating system
    • Screen size and resolution
    • WiFi or Bluetooth enabled

Children

This Application is intended for adults only. We do not knowingly collect information from children under 13.

3. DO THIRD PARTIES HAVE ACCESS TO INFORMATION OBTAINED BY THIS APPLICATION?

We may share information with legally affiliated corporate entities, including Consumer Media LLC and Consumers Union Action Fund, Inc.

With our analytics provider:

We share your information with Mixpanel, which provides analytics services so that we can better understand how this Application is used. We authorize Mixpanel to use for its business purposes aggregated, anonymous information derived from data collected from Application users, for example, to report statistics on industry trends. Mixpanel’s applicable privacy policy terms are available at http://mixpanel.com/terms. Our agreement with Mixpanel does not permit Mixpanel to otherwise share, sell, or distribute information collected from this Application with any third parties for any commercial purposes.

With our other authorized content and service providers:

We share information with authorized service providers who work on our behalf, for example to host Application content. We also share aggregated, anonymous information about the Application with the National Physicians Alliance (NPA), which provides medical content for this Application.

Legal requirements:

We may disclose your information if required by law, for example, to comply with a subpoena or court order.

Protect our Application and Users:

We may disclose your information to investigate, prevent or take action regarding suspected illegal activities or any violation of our Consumer Reports End User License Agreement, or to protect and defend our legal rights, to protect other users or in connection with any safety or security concerns.

Business transfers:

We may share your information in connection with a corporate transaction, for example, the sale of one or more of our businesses, a merger, the creation of a separate business to provide certain of our products and services, the sale or pledge of our assets, or in the unlikely event of bankruptcy, insolvency or receivership. Your information may also be shared in connection with a transaction in which Consumer Reports is seeking financing, investment, support or funding.

4. OPT-ING OUT

You can stop all collection of information by the Application by un-installing the Application.

5. CHANGES TO THIS PRIVACY POLICY

We may change this Privacy Policy from time to time, for example, to reflect changes in the Application’s functions and offerings. If we do so, we will update the Effective Date posted at the top of this Privacy Policy. We will notify you of any material changes to this Privacy Policy by placing a notice in the Application and/or in the Application page within the applicable distribution platform (e.g., Apple’s App Store, Google Play).

6. SECURITY

We are committed to protecting your information from loss, misuse or unauthorized access. IMPORTANT: Please note that no method of transmitting or storing electronic data is ever completely secure. Therefore, we cannot guarantee that such information will never be accessed, used or released in a manner this is inconsistent with this Privacy Policy.

7. YOUR CONSENT

Consumer Reports is a not-for-profit organization headquartered in Yonkers, NY, USA. If you are located outside the United States, the information collected by this Application will be transferred to the United States and governed by applicable United States laws and regulations and this Privacy Policy. Some of this information may be transferred to and processed and stored by our service providers in other countries. By downloading this Application, you consent to its transfer and storage in the United States and other countries designated by Consumer Reports, its governance by United States laws and regulations, and its use in accordance with this Privacy Policy.

9. DISPUTES

Any disputes regarding this Privacy Policy are subject to the Consumer Reports End User License Agreement and will be governed by the laws of the State of New York.
